Notice and Cancellation Terms
This Agreement shall remain in force for an initial period of 12 months from the date of signing of this document and shall continue in force thereafter for successive periods of 12 months unless cancelled by at least one month’s written notice expiring at the end of a 12 month period. Any such written notice should be addressed to CCS Ltd, PO Box 562, Northwich, CW9 9FJ.
In the event that this Agreement is cancelled without giving one month’s written notice of cancellation expiring at the end of a 12 month period a cancellation charge of £150 + VAT for each terminal will be charged.
On cancellation of this agreement for any reason the terminal(s) must be returned in good condition to CCS Ltd, PO Box 562, Northwich, CW9 9FJ. Any damage to the terminal(s) will be the subject of a further charge to the merchant as defined below and a re-stocking fee of £190 + VAT may apply.
The Administration Fee is non-refundable in the event that the Merchant application is declined or cancelled for any reason whatsoever.
Equipment and Associated Charges
When any equipment is supplied under this Agreement you the Merchant are liable howsoever arising for any loss, theft or damage to the equipment and undertake to keep the equipment insured to the value of £1000. You also agree to take all reasonable measures to ensure that the equipment is kept in good order and to return such equipment to CCS when requested on cancellation of this Agreement. In the event that the equipment is not returned to CCS you agree to compensate CCS to the full value of the equipment.
The equipment is to be used in accordance with the manufacturer’s instructions and only operated by persons trained and authorised by you the Merchant.
These charges will apply in the following events (all charges exclude VAT):

The equipment is designed to be self-installed by the Merchant and must be situated within two metres of suitable electricity and telephone points. If Engineer installation is required an installation fee of £125 + VAT will be charged.
The Processing relationship with the Processing Bank is direct between the Processing Bank and the Merchant and save for the agreement of rates does not involve CCS in any way. In particular, the Merchant is responsible for any chargebacks or fees incurred during processing howsoever caused including Minimum Monthly Service Charge.
The Merchant agrees that all information given to CCS for the purpose of processing the Merchant application with the Processing Bank is accurate and to inform CCS in writing if the business profi le of the Merchant materially changes.
The Merchant agrees to complete the PCI Compliance questionnaire and to remain PCI compliant at all times.
CCS agrees to maintain the rates agreed under this agreement subject to processing and transaction levels being maintained as stated overleaf. In the event of changes to the agreed levels, rates will be reviewed annually.
CCS reserves the right to amend rates at any time if base rates outside the control of CCS change for any reason.
The Merchant agrees that the inherent risks in “Cardholder Not Present” (CNP) transactions are fully understood.
The Merchant agrees that it is the Merchant’s responsibility to cancel any existing payment terminal agreement and be responsible for any cancellation charges that may be made.
